They help to define what an effective AML\/CFT\/CPF system looks like in practice and they form the backbone of every mutual evaluation that FATF conducts.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong><strong><strong><strong><strong><strong>How FATF measures effectiveness<\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">FATF makes it clear that technical compliance is necessary but not sufficient. It also needs to see whether those measures actually produce the outcomes they&#8217;re designed to. A country can have fully compliant laws and still score poorly if those laws aren&#8217;t effective in practice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To test effectiveness, FATF&nbsp;looks at all 11 Immediate Outcomes during each mutual evaluation, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>how well a country understands and acts on its ML\/TF\/PF risks;<\/li>\n\n\n\n<li>how effectively its supervisors oversee regulated businesses;<\/li>\n\n\n\n<li>whether preventive measures like customer due diligence (CDD) and\u00a0<a href=\"https:\/\/www.amlcc.com\/who-handles-suspicious-activity-or-transaction-reporting-in-a-firm\/\">suspicious activity reporting<\/a>\u00a0are genuinely working;<\/li>\n\n\n\n<li>and whether law enforcement is able to investigate, prosecute and confiscate the proceeds of crime.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Each Outcome is rated on a four-point scale:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HE = high level of effectiveness<br>SE = substantial level of effectiveness<br>ME = moderate level of effectiveness<br>LE = low level of effectiveness<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong><strong>The 11 Immediate Outcomes<\/strong><\/strong><\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1: Risk, policy and coordination<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Countries need to understand their\u00a0<a href=\"https:\/\/www.amlcc.com\/what-is-money-laundering\/\">money laundering<\/a>,\u00a0<a href=\"https:\/\/www.amlcc.com\/what-is-terrorist-financing\/\">terrorist financing<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.amlcc.com\/what-is-proliferation-financing\/\">proliferation financing<\/a>\u00a0risks and use this knowledge to focus their effort. This shapes most countries\u2019 national risk assessments, which in turn impact what supervisors look for in regulated businesses.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong>2: International cooperation<\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">So much of modern crime\u00a0crosses borders, so countries have to share information and help each other&#8217;s investigations. If your business deals with overseas clients or transactions, your\u00a0<a href=\"https:\/\/www.amlcc.com\/what-is-standard-due-diligence\/\">due diligence<\/a>\u00a0on them is just one part of a much bigger chain.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong><strong>3: Supervision<\/strong><\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Assessing if Supervisors appropriately supervise, monitor and regulate financial institutions and DNFBPs for compliance with AML\/CFT requirements commensurate with their risks.<br><br>Globally this is one of the weakest areas: average effectiveness is around 27%, according to\u00a0<a href=\"https:\/\/index.baselgovernance.org\/api\/assets\/0789b440-8537-45b4-8bfd-e44ac456c15d.pdf\">Basel Institute data<\/a>. The pressure from FATF to improve these numbers is why supervisors scrutiny of regulated businesses keeps increasing.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4: Preventive measures<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Assessing if financial institutions and DNFBPs adequately apply AML\/CFT preventative measures commensurate with their risks, and report suspicious transactions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is day-to-day compliance work for regulated businesses, looking at whether they\u2019re checking who their customers are, watching for suspicious activity and filing reports when something looks suspicious.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong>5: Legal persons and arrangements<\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Criminals can hide behind shell companies or\u00a0<a href=\"https:\/\/www.amlcc.com\/whats-a-layered-ownership-structure\/b\">layered ownership structures<\/a>\u00a0&#8211; and commonly do. This Outcome is about making sure authorities can find out who really owns and controls a company, no matter how it&#8217;s set up.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong><strong>6: Financial intelligence<\/strong><\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When a business files a report on suspicious activity, FATF wants to see what happens to it. This Outcome is about how it gets used (if at all) and turned into real leads on criminal activities.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7: Money laundering investigations and prosecutions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A country needs to prove that its ML\/TF\/PF\u00a0intelligence\u00a0leads somewhere, so FATF will analyse whether law enforcement and prosecutors conduct meaningful investigations, and give proportionate charges and penalties.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8: Confiscation<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Crime cannot be shown to be a lucrative option. Inspectors look at whether\u00a0<a href=\"https:\/\/www.amlcc.com\/what-counts-as-proceeds-of-crime\/\">proceeds of crime<\/a>\u00a0actually get seized or whether the law only technically allows for it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong>9: Terrorist financing investigations and disruptions<\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is similar to Outcome 7 but specifically related to terrorism. The focus here is on stopping the money before it&#8217;s used and disrupting funding early, not just dealing with it after the fact.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong><strong>10: Terrorist financing prosecutions and sanctions<\/strong><\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">FATF also wants to see that countries cut off terrorists&#8217; access to money and the financial system entirely, including making sure they can&#8217;t exploit charities or non-profits to move funds.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><strong><strong><strong>11: Proliferation financing<\/strong><\/strong><\/strong><\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Proliferation financing specifically relates to the proliferation of weapons of mass destruction. Countries and financial institutions need to show they act immediately on sanctions designed to stop funding for WMD development.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why this matters for regulated professionals<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">FATF&#8217;s 11 Immediate Outcomes don\u2019t directly dictate your business\u2019 AML\/CTF\/CPF programme. Instead, they\u2019re a test of whether a country&#8217;s whole system actually works effectively. Your firm&#8217;s day-to-day compliance is one of the links in that chain and is what will be checked for Immediate Outcomes 3 and 4.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This need to prove effectiveness is why supervisors are so focused on the preventative measures that regulated businesses have in place, such as customer due diligence, risk assessments, PCPs, transaction monitoring, filing their suspicions properly and training. Proving you have the correct paperwork is no longer sufficient; proving the outcome of your work is effective is now crucial.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These activities are part of the evidence base that&nbsp;FATF&nbsp;uses to judge whether a country\u2019s whole system is working.
