It\u2019s not about the specific funds used in a single transaction (which is known as source of funds) but the bigger picture:&nbsp;how did this person or business come to have the wealth they hold today?&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/www.legislation.gov.uk\/uksi\/2017\/692\/contents\/made\">UK Money Laundering Regulations 2017&nbsp;<\/a>(as amended) (MLRs) require firms to take a risk\u2011based approach to due diligence. This means you need to understand source of funds in all relevant cases and in higher\u2011risk situations, such as&nbsp;<a href=\"https:\/\/www.amlcc.com\/how-should-peps-be-treated-during-onboarding\/\">politically exposed persons&nbsp;<\/a>(PEPs) or high\u2011risk third countries, establish source of wealth. These checks need to be backed up with appropriate evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sector guidance all follows this principle, with&nbsp;definitions&nbsp;that stem from the requirements in MLRs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What source of wealth means in each sector<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Accountancy sector\u00a0<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.ccab.org.uk\/wp-content\/uploads\/2023\/08\/AMLGAS-update-June-2023-APPROVED.pdf\">AMLGAS&nbsp;<\/a>adopts a straightforward definition:&nbsp;\u201cThe origin of the subject\u2019s total assets.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accountants, bookkeepers and all related businesses are expected to establish source of funds for all transactions, and source of wealth as well when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>enhanced due diligence applies;<\/li>\n\n\n\n<li>the client\u2019s financial position doesn\u2019t match their profile;<\/li>\n\n\n\n<li>ownership structures are opaque; or<\/li>\n\n\n\n<li>transactions appear unusually large or complex.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.amlcc.com\/what-is-enhanced-due-diligence\/\">Enhanced due diligence<\/a>&nbsp;is likely to apply when&nbsp;you have a higher&nbsp;risk, such as PEPs, clients connected to high\u2011risk third countries or complex or unusual arrangements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Legal sector\u00a0<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.sra.org.uk\/globalassets\/documents\/solicitors\/firm-based-authorisation\/lsag-aml-guidance.pdf\">LSAG<\/a>&nbsp;provides the most detailed treatment of source of wealth:&nbsp;\u201cThe source of wealth refers to the origin of a client\u2019s entire body of wealth. SoW&nbsp;describes the economic, business and\/or commercial activities that generated the client\u2019s overall net worth.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legal businesses must establish source of funds for the transactions or activities that occur within the business relationship or occasional transaction, and source of wealth as well in situations such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>all PEP relationships;<\/li>\n\n\n\n<li>cross-border or sanctions-linked matters;<\/li>\n\n\n\n<li>high-value or unusual property transactions; or<\/li>\n\n\n\n<li>complex trust or company structures.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This needs to be backed up with relevant documentation, with the depth of checks driven by the risk assessment for the client and the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Property sector<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">HMRC defines source of wealth for property professionals in the \u2018<a href=\"https:\/\/www.gov.uk\/government\/publications\/money-laundering-regulations-2007-supervision-of-estate-agency-businesses\">Estate and letting agency business guidance for money laundering supervision<\/a>\u2019 as the \u201corigin of the customer\u2019s overall wealth.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Property professionals must establish source of wealth in cases involving:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>PEPs and high-risk jurisdictions;<\/li>\n\n\n\n<li>high-value purchases;<\/li>\n\n\n\n<li>offshore buyers or corporate purchasers; or<\/li>\n\n\n\n<li>clients whose background doesn\u2019t match their financial position.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In conveyancing, establishing a client\u2019s financial background is central to ensuring that a transaction aligns with their profile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>High-Value Dealers (HVDs)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.gov.uk\/government\/publications\/anti-money-laundering-guidance-for-high-value-dealers\">HMRC\u2019s guidance for&nbsp;HVDs<\/a>&nbsp;is to understand both the source of funds and the wider source of wealth when risk indicators appear. For HVDs, source of wealth becomes particularly important in situations such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>large cash purchases with no clear explanation;<\/li>\n\n\n\n<li>customers whose occupation or circumstances don\u2019t align with the value of the goods;<\/li>\n\n\n\n<li>repeated high-value cash transactions over a short period;<\/li>\n\n\n\n<li>buyers linked to high-risk jurisdictions or industries; or<\/li>\n\n\n\n<li>customers unwilling to explain how they accumulated their wealth.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Because cash-heavy sectors are routinely exposed to money laundering risks, HMRC expects HVDs to be able to demonstrate that the client\u2019s financial background makes sense relative to the transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When source of wealth cannot be established, or when the explanation contradicts what you know about the customer, this is a clear trigger for enhanced due diligence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What credible source of wealth information looks like<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The explanation of source of wealth must be credible and proportionate to risk. Regulators give examples such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Long-term employment or professional income<\/li>\n\n\n\n<li>Profits from a legitimate business<\/li>\n\n\n\n<li>Inheritance (with probate documents where appropriate)<\/li>\n\n\n\n<li>Sale of property or other assets<\/li>\n\n\n\n<li>Long-term investments<\/li>\n\n\n\n<li>Pension income or retirement assets<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Your test is whether the explanation reasonably accounts for the client\u2019s wealth and is consistent with what you know.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Red flags to watch for<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Across AMLGAS, LSAG and HMRC guidance, the key warning signs are consistent:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wealth that doesn\u2019t match the client\u2019s known background<\/li>\n\n\n\n<li>Explanations relying on vague phrases such as\u00a0\u201cfamily money\u201d or\u00a0\u201cvarious investments\u201d<\/li>\n\n\n\n<li>Wealth linked to high-risk jurisdictions without evidence<\/li>\n\n\n\n<li>Reluctance to explain or discuss financial background<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where this occurs,&nbsp;<a href=\"https:\/\/www.amlcc.com\/what-is-enhanced-due-diligence\/\">enhanced due diligence<\/a>&nbsp;may be required or you may need to consider whether the relationship can proceed safely.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Final thoughts<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Understanding source of wealth helps you test whether a client\u2019s financial story is coherent and legitimate. A clear explanation strengthens your risk assessment. A vague one, or one that doesn\u2019t fit, is often the first indication that you need to look closer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guidance across AMLGAS, LSAG and HMRC is aligned: source of wealth is about the origin of the client\u2019s total assets. A clear explanation, with proportionate evidence to support it, helps you assess risk and confirm it\u2019s in line with what you already know about the client.
